Cancellation Policy for Consumers

Important Information Regarding Contractual Partnership

Bazario (Hassan Abou Ras) operates an online marketplace and facilitates purchase agreements between independent sellers and customers. The purchase agreements are made directly between you as the customer and the respective seller.

Your contractual partner for the cancellation is therefore the respective seller, not Bazario. The seller is clearly identified with each item and in the order confirmation.

Exception: If Bazario itself acts as the seller (marked as “Seller: Bazario”), Bazario is your direct contractual partner.

Right of Withdrawal

Your Right of Cancellation as a Consumer

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day:

      • for goods deliveries: on which you or a third party named by you, who is not the carrier, have taken possession of the goods
      • for multiple goods in one order: on which you or a third party named by you have taken possession of the last item
      • for goods in several partial shipments: on which you or a third party named by you have taken possession of the last partial shipment
      • for digital content: from the day the contract is concluded

How can you declare your cancellation?

Important: You must declare the cancellation to the respective seller, not to Bazario.

  • On the product page under “Seller Information”
  • Via the seller profile on bazario.de
  1. Form of the cancellation declaration

To exercise your right of cancellation, you must inform the respective seller of your decision to cancel this contract by means of a clear declaration.

Accepted forms:

      • Email to the seller’s email address
      • Letter to the seller’s postal address
      • Via the Bazario platform: Use the “Cancellation” function in your customer account (will be automatically forwarded to the seller)
      • Telephone (if offered by the seller)

You can use the attached sample cancellation form, but you are not obliged to do so.

  1. Compliance with the time limit

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal
Refund of Payments

If you cancel this contract, the seller must refund all payments that they have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by the seller) immediately and at the latest within fourteen days from the day on which the notification of your cancellation was received by the seller.

Method of Repayment

The refund will be made using the same payment method that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees for this refund.

Technical processing: Since the payments were processed via Bazario, the refund is technically processed via the Bazario payment system according to the seller’s instructions.

Return of Goods

You must return or hand over the goods to the seller immediately and in any case no later than fourteen days from the day on which you informed the seller of the cancellation.

The deadline is met if you send the goods before the expiry of the fourteen-day period.

Bearing the Costs of the Return

The direct costs of the return are generally borne by the customer, unless the seller has agreed to bear these costs or fails to inform you about the obligation to bear the costs.

  • In the order confirmation
  • In your customer account
  • Upon request from the seller
Compensation for Loss of Value

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the nature, properties and functionality of the goods.

Exceptions to the Right of Cancellation

The right of cancellation does not apply to the following contracts:

Goods Exceptions:
      • Goods that are made to customer specifications or are clearly tailored to personal needs
      • Goods that can spoil quickly or whose expiration date would be quickly exceeded
      • Sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery
      • Goods that, after delivery, are inseparably mixed with other goods due to their nature
      • Alcoholic beverages whose price was agreed upon at the time of conclusion of the contract and which can be delivered no earlier than 30 days after conclusion of the contract and whose current value depends on fluctuations in the market
      • Newspapers, magazines or illustrated magazines (except for subscription contracts)
Digital Content:
      • Digital content that is not delivered on a physical data carrier if the seller has started with the execution before the end of the cancellation period, after you have expressly agreed and confirmed that you lose your right of cancellation
Services:
      • Service contracts if the seller has provided the service in full and only started with the execution after you have expressly agreed and at the same time confirmed that you lose your right of cancellation as soon as the contract is completely fulfilled
Special Features for Different Product Categories
Food and Perishable Goods

The right of cancellation is excluded for rapidly perishable foods. For other foods, special hygiene regulations apply to the return.

Digital Products
      • Software/Apps: Right of cancellation expires upon commencement of download after express consent
      • E-Books/Music: Right of cancellation expires upon commencement of download
      • Online services: Right of cancellation may expire upon complete provision
Cosmetics and Hygiene Products

The right of cancellation is excluded if the seal has been removed for reasons of hygiene protection after delivery.

      • Forwarding of cancellation declarations to sellers
      • Payment reversal according to the seller’s instructions
      • Customer service for mediation in case of problems

No Liability for Seller Behavior

Bazario is not Liable for:
      • Delays in processing by sellers
      • Rejection of justified cancellations by sellers
      • Quality of customer service by sellers
