Part I: General Terms and Conditions

§ 1 Scope and Definitions

(1) Scope These General Terms and Conditions (GTC) apply to the use of the online marketplace "Bazario" under the internet address https://bazario.de (hereinafter "Platform" or "Marketplace") as well as to all legal transactions processed via it.

(3) Definitions

      • Consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
      • Entrepreneur is any natural or legal person or a legal partnership that, when concluding a legal transaction, acts in the exercise of its independent professional or commercial activity.
      • Seller or Vendor are entrepreneurs registered on the platform who offer goods for sale via their own seller accounts.
      • Customers or Buyers are users of the platform who purchase goods from sellers (consumers or entrepreneurs).

§ 2 Contractual Relationships and Role Description

(1) Intermediary role of the platform Bazario operates an online marketplace within the meaning of Art. 246a § 1 EGBGB and exclusively brokers contracts between registered sellers and customers. Bazario is generally not a contracting party to the purchase contracts processed via the platform. The purchase contracts are concluded directly between the respective seller and the customer.

(2) Proprietary trading If Bazario itself acts as a seller (clearly marked as "Seller: Bazario"), the following provisions apply accordingly to the direct contractual relationship between Bazario and the customer.

(3) Vertragspartner-Kennzeichnung Bei jedem Artikel und im gesamten Bestellprozess wird der jeweilige Verkäufer eindeutig gekennzeichnet. Der Kunde kann die vollständigen Angaben nach § 5 TMG (Impressum) des jeweiligen Verkäufers über die Verkäuferprofilseite einsehen.

(4) Platform Services Bazario provides the following services:

      • Provision of the technical infrastructure
      • Payment processing via third-party providers
      • Customer support (mediating)
      • Rating and communication system
      • Dispute management (mediating)

§ 3 Use of the Platform

(1) Registration and user account Registration is required to use certain functions of the platform. When registering, truthful and complete information must be provided. The user is obliged to keep his data up to date.

(2) Usage requirements

      • Customers: Minimum age 18 years or consent of the legal guardians
      • Sellers: Trade license and fulfillment of all legal requirements for trading

(3) Prohibited use The following are specifically prohibited:

      • The posting of illegal, harmful to minors or immoral content
      • Violation of the rights of third parties (trademark, copyright, personal rights)
      • Manipulation of ratings or unfair business practices
      • Circumvention of the platform payment systems
      • Spam or abusive use of the communication systems

§ 4 Seller Obligations and Responsibilities

(1) Legality of the offer Sellers are fully responsible for ensuring that their offers comply with the statutory provisions, in particular:

      • Compliance with the imprint obligation (§ 5 TMG)
      • Product safety and CE marking
      • Youth protection regulations
      • Price Indication Ordinance
      • Distance selling regulations

(2) Product presentation Sellers commit to:

      • Truthful and complete product description
      • Current price and availability information
      • Appropriate image quality without misleading presentation
      • Specification of all essential product characteristics

(3) Order processing and data protection Sellers process customer data exclusively for order processing in accordance with the mandatory order processing agreement (AVV) according to Art. 28 GDPR. Use for advertising purposes or disclosure to third parties is prohibited.

(4) Communication obligations Sellers are obliged to:

      • Answer customer inquiries within 24 hours
      • Send order confirmations immediately
      • Transmit shipping and tracking information
      • To communicate proactively in case of problems

§ 5 Conclusion of Purchase Contracts

(1) Offer and acceptance Placing a product on the platform constitutes a binding offer by the respective seller. The purchase contract is concluded by the acceptance of the offer by the customer by clicking on "Buy “/"Order”.

(2) Ordering process The ordering process takes place in the following steps:

      1. Selection of goods and addition to the shopping cart
      2. Entry of order and delivery data
      3. Selection of the payment method
      4. Review and confirmation of all information in the order overview
      5. Binding order by clicking on "order subject to payment"

(3) Order confirmation Immediately after sending the order, the customer receives an automatic confirmation of receipt by e-mail. This does not yet constitute acceptance of the contract offer. The seller confirms the acceptance by separate order confirmation.

§ 6 Payment processing

(1) Available payment methods The available payment methods are displayed in the order process and include:

      • Credit card (via Stripe)
      • PayPal
      • SEPA direct debit
      • Other payment methods provided by third-party providers

(2) Payment processing by third-party providers Payment processing is carried out by the payment service providers:

      • Stripe: Stripe Payments Europe Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland
      • PayPal: PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal L-2449, Luxembourg

(3) Payment flow and escrow function Bazario acts as the payment recipient and forwards the payments to the respective sellers after deducting the platform fees. In case of problems, payments can be temporarily withheld.

(4) Due date The purchase price is due immediately upon conclusion of the contract, unless otherwise agreed.

§ 7 Right of Withdrawal and Return

Your right of withdrawal exists towards the respective seller, not towards Bazario.

(1) Right of withdrawal in consumer contracts Consumers have a statutory 14-day right of withdrawal from distance contracts vis-à-vis the respective seller.

      • The seller (not Bazario) is your contractual partner for the revocation

(2) Jurisdiction and contractual partner

      • Declaration of revocation: Send it to the respective seller (contact details in your order confirmation)
      • Refund: Is made by the seller via the Bazario payment system
      • Return: To the address specified by the seller

(3) Bazario's supporting role Bazario offers technical support and mediation for cancellation requests, but is not authorized to accept cancellations (except for proprietary trading as “Seller: Bazario”).

(4) In case of problems If the seller does not respond appropriately to your revocation, please contact our customer service for mediation.

§ 8 Warranty and Liability

(1) Seller liability The sellers are fully responsible for the fulfillment of the purchase contracts, warranty and product liability. The statutory provisions of liability for defects apply.

(2) Disclaimer Bazario Bazario is not liable for:

      • Contract fulfillment of the sellers
      • Quality, safety or legality of the offered goods
      • Availability or delivery times
      • Customer service of the sellers

(3) Liability of Bazario Bazario is only liable:

      • In case of intent and gross negligence without limitation
      • In the event of negligent breach of essential contractual obligations, to the foreseeable, typical contractual damage
      • According to the Product Liability Act, for personal injury and damage to health

(4) Limitation of liability Liability is otherwise excluded. This does not apply to injury to life, body and health.

§ 9 Data Processing and Data Protection

(1) Data protection declaration Our data protection declaration, which can be accessed at https://bazario.de/datenschutz, applies to the processing of personal data.

(2) Data processing by sellers Sellers process customer data exclusively for order processing as a processor within the meaning of Art. 28 GDPR. Use for advertising purposes or disclosure to third parties is prohibited.

(3) Order processing agreement All sellers are obliged to agree to the order processing agreement (AVV), which regulates the data protection regulations.

§ 10 Rating System

(1) Rating authorization Only customers who have actually placed an order with a seller are entitled to rate.

(2) Rating guidelines Ratings must:

      • Be truthful and factual
      • Refer to the specific transaction
      • Be free of offensive or illegal content

(3) Deletion of ratings Bazario reserves the right to delete ratings that violate these guidelines.

§ 11 Termination and Blocking

(1) Ordinary termination User accounts can be terminated at any time without giving reasons. The termination must be made in writing or by e-mail.

(2) Extraordinary termination and blocking Bazario can block or terminate user accounts without notice in the event of serious violations of these GTC or applicable law, in particular in the event of:

      • Sale of prohibited or dangerous goods
      • Fraud or deception
      • Violation of the rights of third parties
      • Manipulation of the rating system

(3) Consequences of the blocking In the event of a blocking, all active offers will be removed and access to the platform will be blocked. Ongoing transactions will be processed properly.

§ 12 Amendment of the GTC

(1) Right to change Bazario reserves the right to change these GTC at any time. Changes will be communicated to users by e-mail.

(2) Consent to changes If the user does not object to the changes within 14 days of receipt of the notification, the changes shall be deemed approved. This consequence is pointed out in the notification.

(3) Right of objection If you object to the changes, the user relationship can be terminated.

§ 13 Dispute Resolution

(1) EU Online Dispute Resolution Platform The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/odr

(2) Consumer conciliation Bazario is not obliged to participate in dispute resolution proceedings before consumer conciliation bodies.

§ 14 Final Provisions

(1) Choice of law The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In the case of consumers, this choice of law only applies insofar as it does not affect any mandatory consumer protection provisions of the country of their habitual residence.

(2) Place of jurisdiction The place of jurisdiction for all disputes is Wiesbaden, provided that the contracting party is a merchant, a legal entity under public law or a special fund under public law.

(3) Severability clause Should individual provisions of these GTC be ineffective or unenforceable, this shall not affect the effectiveness of the remaining provisions.

(4) Language The contract language is German.

Note: As an online marketplace, Bazario brokers contracts between independent sellers and customers. The contracts are concluded directly between the respective seller and the customer. The respective contractual partner is clearly identified with each article and in the ordering process.

  1. Information about the sellers

The complete information about each seller (company name, address, contact details, commercial register entry, VAT ID, etc.) can be found:

      • On the respective product page under “Seller”
      • In the seller profile page
      • In the order confirmation
  1. Essential features of the brokerage service

Bazario provides an online platform through which:

      • Sellers can present their goods
      • Customers can search and buy goods
      • Payments can be processed securely
      • Communication between the parties is enabled
      • Ratings and reviews can be exchanged
  1. Conclusion of the brokerage contract

The user agreement with Bazario comes about through:

      • Registration on the platform or
      • First use of the platform services (even without registration).
  1. Prices and fees

For customers: The use of the platform is free of charge. Only the purchase prices and shipping costs agreed with the respective sellers are incurred.

For sellers: Separate fee regulations apply, which can be viewed in the seller area.

  1. Payment modalities

Payment is made via the payment method selected in the respective order directly to Bazario, which takes over the forwarding to the seller.

Available payment methods:

      • Credit card (Visa, Mastercard, American Express)
      • PayPal
      • SEPA direct debit
      • More depending on the offer
  1. Delivery conditions

Delivery: The delivery is carried out by the respective seller. Delivery conditions, times and costs are shown separately for each article.

Transfer of risk: In the case of consumers, the risk only passes to the customer when the goods are handed over.

  1. Right of withdrawal for consumers

Important note: The right of withdrawal exists towards the respective seller, not towards Bazario. The revocation instructions of the respective seller can be found on his profile page and in the order confirmation.

General withdrawal period: 14 days from receipt of the goods.

Exceptions to the right of withdrawal exist in particular for:

      • Goods that have been manufactured according to customer specifications
      • Sealed goods that are not suitable for return for reasons of health protection
      • Goods that have been mixed after delivery
      • Alcoholic beverages when delivered after 30 days after conclusion of the contract
  1. Warranty

Statutory warranty: The statutory warranty rights apply vis-à-vis the respective seller.

Liability for defects: In the event of defects, please contact the seller directly or use our customer service system for mediation.

Consumer conciliation: Bazario does not participate in proceedings before consumer conciliation bodies. For disputes regarding the purchase contracts, please contact the respective seller.

  1. Information on storing the contract text

Order data: After completing an order, you will receive all relevant contract data by email.

Account access: Registered users can view their order history in their customer account at any time.
